ਕਿਸੇ ਥਾਂ ਦੀ ਤਲਾਸ਼ੀ (Search of a place)

ਕਿਸੇ ਦੋਸ਼ੀ ਨੂੰ ਗ੍ਰਿਫ਼ਤਾਰ ਕਰਨ, ਜ਼ੁਰਮ ਵਿੱਚ ਵਰਤੇ ਗਏ ਹਥਿਆਰਾਂ ਨੂੰ ਬਰਾਮਦ ਕਰਨ ਜਾਂ ਚੋਰੀ ਆਦਿ ਹੋਏ ਮਾਲ-ਮੁਕੱਦਮੇ ਨੂੰ ਬਰਾਮਦ ਕਰਨ ਲਈ ਪੁਲਿਸ ਨੂੰ ਰਿਹਾਇਸ਼ੀ ਜਾਂ ਵਪਾਰਿਕ ਥਾਵਾਂ ਦੀ ਤਲਾਸ਼ੀ, ਬਿਨ੍ਹਾਂ ਵਰੰਟ ਲਏ ਕਰਨ ਦਾ ਅਧਿਕਾਰ ਹੈ।

ਤਲਾਸ਼ੀ ਦੌਰਾਨ ਪੁਲਿਸ ਕੋਈ ਵਧੀਕੀ ਨਾ ਕਰ ਦੇਵੇ ਇਹ ਯਕੀਨੀ ਬਣਾਉਣ ਲਈ ਕਾਨੂੰਨ ਵੱਲੋਂ ਪੁਲਿਸ ਅਫ਼ਸਰ ਨੂੰ ਇਹ ਹਿਦਾਇਤ ਕੀਤੀ ਗਈ ਹੈ ਕਿ ਉਹ ਅਜਿਹੀਆਂ ਥਾਵਾਂ ਦੀ ਤਲਾਸ਼ੀ ਕਰਦੇ ਸਮੇਂ ਘੱਟੋ-ਘੱਟ ਦੋ ਆਲੇ-ਦੁਆਲੇ ਦੇ ਮੋਹਤਵਰ ਵਿਅਕਤੀਆਂ ਨੂੰ ਤਲਾਸ਼ੀ ਸਮੇਂ ਕਾਰਵਾਈ ਵਿੱਚ ਸ਼ਾਮਿਲ ਕਰੇ।

ਪੁਲਿਸ ਅਫ਼ਸਰ ਨੇ ਜੇ ਤਲਾਸ਼ੀ ਕਿਸੇ ਹੋਰ ਥਾਣੇ ਦੇ ਇਲਾਕੇ ਵਿੱਚ ਕਰਨੀ ਹੋਵੇ ਤਾਂ ਉਸ ਲਈ ਜ਼ਰੂਰੀ ਹੈ ਕਿ ਉਹ ਤਲਾਸ਼ੀ ਵਾਲੇ ਹਲਕੇ ਦੇ ਥਾਣੇ ਦੇ ਮੁਖੀ ਪੁਲਿਸ ਅਫ਼ਸਰ ਨੂੰ ਪਹਿਲਾਂ ਸੂਚਿਤ ਕਰੇ। ਕਿਹਨਾਂ ਹਾਲਾਤ ਵਿੱਚ ਇਹਨਾਂ ਹਿਦਾਇਤਾਂ ਦੀ ਪਾਲਣਾ ਕਰੇ ਬਿਨ੍ਹਾਂ ਕਿਸੇ ਥਾਂ ਦੀ ਤਲਾਸ਼ੀ ਲਈ ਜਾ ਸਕਦੀ ਹੈ।

ਪਰ ਇਨ੍ਹਾਂ ਹਦਾਇਤਾਂ ਦੀ ਪਾਲਣਾ ਲਾਜ਼ਮੀ (mandatory) ਨਹੀਂ ਹੈ। ਵਿਸ਼ੇਸ਼ ਹਾਲਾਤ ਵਿਚ ਜੇ ਇਨ੍ਹਾਂ ਹਦਾਇਤਾਂ ਦੀ ਪਾਲਣਾ ਹੋ ਸਕੇ ਫਿਰ ਵੀ ਤਲਾਸ਼ੀ ਕਾਨੂੰਨ ਅਨੁਸਾਰ ਹੀ ਮੰਨੀ ਜਾਂਦੀ ਹੈ।

1. ਤਲਾਸ਼ੀ ਸਮੇਂ ਨਿਰਪੱਖ ਵਿਅਕਤੀ ਦਾ ਉਪਲੱਬਧ ਨਾ ਹੋਣਾ

ਕਿਸੇ ਥਾਂ ਦੀ ਤਲਾਸ਼ੀ ਸਮੇਂ ਜੇ ਤਫਤੀਸ਼ੀ ਅਫਸਰ ਵੱਲੋਂ ਕਿਸੇ ਨਿਰਪੱਖ ਵਿਅਕਤੀ ਨੂੰ ਤਲਾਸ਼ੀ ਦੀ ਕਾਰਵਾਈ ਵਿੱਚ ਸ਼ਾਮਿਲ ਨਹੀਂ ਕੀਤਾ ਜਾਂਦਾ ਤਾਂ ਤਲਾਸ਼ੀ ਨੂੰ ਕੇਵਲ ਇਸੇ ਅਧਾਰ ਤੇ ਗੈਰ-ਕਾਨੂੰਨੀ ਨਹੀਂ ਠਹਿਰਾਇਆ ਜਾ ਸਕਦਾ।

Para “22. ….. The police officer said that they made an effort to secure at least two persons from Connaught Place but none was willing to be a witness. It is no surprise that any of the traders of Connaught Place would be unwilling to offer his service as a witness to any police action if he knew that he would have to bear all the sufferings thereafter, to give evidence in a Criminal Court, more so, when that Court would be at a far off place in a different State altogether. City people are quite conscious of such consequences and they would normally be wary to signify to such witnessing. The evidence of the police officer that nobody was willing to stand as a witness in Ext. P-80 cannot, therefore, be spurned down as improbable.”

2. ਮੁੱਖ ਅਫਸਰ ਦੀ ਥਾਂ ਉਸਦੇ ਉੱਚ ਅਧਿਕਾਰੀ ਨੂੰ ਸੂਚਿਤ ਕਰਨਾ

ਜੇ ਇੱਕ ਤਫਤੀਸ਼ੀ ਅਫਸਰ ਕਿਸੇ ਹੋਰ ਥਾਣੇ ਦੀ ਹੱਦ ਵਿੱਚ ਪੈਂਦੀ ਥਾਂ ਦੀ ਤਲਾਸ਼ੀ ਕਰਦਾ ਹੈ ਅਤੇ  ਉਸ ਤਲਾਸ਼ੀ ਦੀ ਸੂਚਨਾ ਉਸ ਥਾਣੇ ਦੇ ਮੁੱਖ ਅਫਸਰ ਦੀ ਥਾਂ ਕਿਸੇ ਉੱਚ ਅਧਿਕਾਰੀ ਨੂੰ ਦੇ ਦਿੰਦਾ ਹੈ ਤਾਂ ਅਜਿਹੀ ਤਲਾਸ਼ੀ ਨੂੰ ਗੈਰ-ਕਾਨੂੰਨੀ ਨਹੀਂ ਠਹਿਰਾਇਆ ਜਾ ਸਕਦਾ।

Para “25. ….. PW 37 (Sanjay Aksetriya) the Circle Officer of the police station under whose leadership the raid was conducted at Alka Hotel has said in cross-examination that he had given the information to the higher officer of the area who agreed to inform the police officers of Delhi at their own level. There can be no grievance that a copy of the search has not been forwarded to the Court concerned.”
